PRICE LIST AND TERMS OF PAID SERVICES – PRACOŠ.SK

I. OPERATOR

The operator of the Pracoš.sk online portal is:

registered in the Commercial Register of the District Court Prešov, Section Sro, Insert No. 53615/P

hereinafter referred to as the “Operator”.

These terms govern the prices, ordering, activation, use and payment of paid services provided through the Pracoš.sk portal.

They form an integral part of and are linked to the Terms and Conditions of Pracoš.sk and the Advertising Rules of Pracoš.sk.

II. PUBLICATION OF A JOB OFFER

A job offer is published on Pracoš.sk for a period of 30 days.

Current price:

Publication of a job offer for 30 days: FREE

Free publication of job offers represents the introductory pricing period of the Pracoš.sk portal.

Standard price:

After the end of the introductory free period, the standard price will be:

Publication of a job offer for 30 days: €5

The Operator will announce the introduction of paid job offer publication through the Pracoš.sk portal.

The subsequent introduction of a publication fee will not have retroactive effect on job offers published during the free period.

III. JOB OFFER PUBLICATION PERIOD

The standard publication period of a job offer is 30 days from the date of its publication.

After this period expires, the job offer will cease to be active unless it is protected against expiration by an active TOP service in accordance with these terms.

TOP promotion itself does not change the original expiration date of the job offer.

IV. TOP SERVICE

TOP is a paid additional service intended to increase the visibility of a job offer in the search results on Pracoš.sk.

During an active TOP service, the job offer is marked with a TOP label.

TOP promotion works by regularly and automatically updating the publication date and time of the job offer.

Each time a TOP action is performed, the publication date and time of the job offer are reset to the current date and time.

As job offers are normally sorted in search results by publication date from newest to oldest, each TOP action moves the job offer back among the newest job offers.

V. HOW TOP WORKS

The first TOP action is performed immediately after successful activation of the TOP service.

Each subsequent TOP action is performed automatically after another 24 hours have elapsed.

For example:

TOP 7 days = 7 TOP actions

• the first TOP action immediately after activation,
• the second TOP action after 24 hours,
• the third TOP action after 48 hours,
• and subsequently every 24 hours,
• for a total of 7 TOP actions.

The same principle applies to TOP 14, TOP 21 and TOP 30.

VI. TOP SERVICE PRICE LIST

The first TOP action is performed immediately after activation of the service, and the remaining TOP actions are performed automatically at 24-hour intervals.

VII. TOP AND JOB OFFER EXPIRATION

TOP promotion does not change the original expiration date of the job offer.

However, if the expiration date of the job offer occurs while the TOP service is active, the job offer will not expire during the active TOP service.

The job offer will remain active until the purchased TOP service ends.

The user may therefore purchase a TOP service even if the time remaining until the original expiration date of the job offer is shorter than the duration of the purchased TOP service.

An active TOP service ensures that the job offer remains active for the entire duration of the TOP service.

VIII. VIRTUAL WALLET

A registered user may use a virtual wallet on the Pracoš.sk portal.

The virtual wallet allows the user to purchase credit in advance and subsequently use that credit to pay for paid services on Pracoš.sk.

Credit may be used in particular for:

• TOP promotion of job offers,
• payment for publication of a job offer after paid publication is introduced,
• payment for other paid services that Pracoš.sk may offer in the future.

IX. CREDIT TOP-UP

The user may purchase the following amounts of credit:

X. BONUS CREDIT

With each virtual wallet top-up, the Operator provides the user with bonus credit equal to 20% of the amount paid.

For example:

if the user pays €100, a total credit of €120 will be added to the user’s virtual wallet.

Of this amount:

• €100 represents credit paid for by the user,
• €20 represents bonus credit provided by the Operator.

Bonus credit may be used to pay for Pracoš.sk services in the same manner as purchased credit unless otherwise stated for a particular service.

Bonus credit cannot be exchanged for cash and the user is not entitled to request its cash payment.

XI. CREDIT VALIDITY

Neither purchased credit nor bonus credit has a time-limited validity period.

Credit does not expire merely due to the passage of time.

Unused credit remains available to the user in the virtual wallet for as long as the user’s account exists, except in cases provided for by these terms or by the Terms and Conditions of Pracoš.sk.

XII. PAYMENT USING CREDIT

If the user has a sufficient balance in the virtual wallet, the user may use it to pay for a selected paid service.

After the order is confirmed, the price of the service will be deducted from the available balance of the virtual wallet.

Before ordering a service, the user may view the price of the service and the current credit balance.

Credit represents a means intended for purchasing services on Pracoš.sk. It is not a bank account or a payment account.

XIII. GOPAY PAYMENT GATEWAY

Payments for credit and other services for which direct payment is available are processed through the GoPay payment gateway.

Depending on the current availability of individual payment methods, users may be offered in particular:

• payment by debit or credit card,
• instant payment via bank payment buttons / internet banking,
• Apple Pay,
• Google Pay.

The availability of a particular payment method may depend on the user’s device, bank, payment card, payment gateway settings or other technical conditions.

The Operator therefore does not guarantee the permanent availability of every individual payment method.

XIV. ACTIVATION OF A PAID SERVICE

A paid service is activated after successful completion of payment or successful deduction of the relevant amount from the virtual wallet.

For a TOP service, the first TOP action is performed immediately after successful activation of the service.

If payment is not successfully completed, the paid service may not be activated.

XV. INFORMATION BEFORE PLACING AN ORDER

Before confirming an order for a paid service, the user will be provided in particular with information about:

• the type of service being ordered,
• the price of the service,
• the duration or scope of the service, where relevant,
• the payment method.

For a TOP service, the user will be informed that TOP promotion does not change the original expiration date of the job offer, while the job offer will not expire during the active TOP service.

XVI. ACCOUNT CLOSURE AND CREDIT BALANCE

When a user account is closed, the user’s ability to use the virtual wallet and purchase Pracoš.sk services from the wallet ends.

If unused paid credit remains in the virtual wallet at the time the account is closed, the user may request financial settlement of that credit from the Operator.

The user must request settlement of the remaining paid credit in writing, in particular via the Operator’s contact email address.

Only the portion of unused credit corresponding to funds actually paid by the user may be subject to financial settlement.

Bonus credit will not be paid out or refunded and cannot be exchanged for cash.

Closing an account does not in itself constitute a request for payment of the remaining credit balance.

This provision does not affect any rights of the user that cannot be excluded or restricted under applicable mandatory law, including consumer rights where such rights apply to the particular contractual relationship.

XVII. REFUNDS AND COMPLAINTS

If a paid service was not provided due to a technical error on the part of Pracoš.sk, or if credit was incorrectly deducted, the user may contact the Operator and request a review of the transaction.

If an incorrect deduction of credit or failure to provide a paid service due to circumstances attributable to the Operator is confirmed, the Operator will provide an appropriate remedy, in particular by restoring the relevant credit, providing the service or refunding the relevant payment, depending on the circumstances.

This does not affect any statutory consumer rights relating to complaints, withdrawal from a contract or refunds in cases where such rights are granted by applicable law.

XVIII. TAX AND ACCOUNTING DOCUMENTS

Appropriate accounting or tax documents will be issued for payments made in accordance with applicable law.

The user is responsible for the accuracy of the billing information provided to the Operator.

The Operator may use the POHODA accounting system to process accounting and billing information.

XIX. PRICES

Prices of paid services are stated in the current Pracoš.sk Price List.

Before making a payment or using credit, the user will be shown the current price of the service being ordered.

The Operator may change the prices of services in the future.

A price change will not retroactively affect any service that has already been properly purchased and activated or any credit that has already been credited to the user’s virtual wallet.

The user will not subsequently be charged the difference between the original price and the new price of a service already purchased.

XX. CHANGE FROM FREE TO PAID ADVERTISING

During the introductory period, standard publication of a job offer is free of charge.

The Operator is entitled to end the introductory free period and introduce the standard price of €5 for publication of a job offer for 30 days.

The introduction of paid publication will not have retroactive effect on job offers that were properly published free of charge before the new price became effective.

After paid publication is introduced, the price will be displayed to the user before the order is confirmed.

XXI. CHANGES TO THE PRICE LIST AND PAID SERVICES

The Operator may reasonably amend the Price List and the range of paid services, in particular due to the introduction of new services, changes to the scope of existing services, changes to the business model or changes in prices.

The price displayed to the user before the binding confirmation of the order is decisive for that order.

A change to the Price List will not affect a service that has already been paid for and activated.

XXII. RELATIONSHIP TO OTHER TERMS

In addition to these terms, the use of paid services is governed in particular by:

• Terms and Conditions of Pracoš.sk,
• Advertising Rules of Pracoš.sk,
• Privacy Policy of Pracoš.sk,
• Cookie Policy of Pracoš.sk.

In the event of a conflict between the general provisions of the Terms and Conditions and the specific provisions concerning the price or operation of a particular paid service contained in this document, the specific provisions of this document shall prevail in relation to that paid service, unless mandatory applicable law provides otherwise.
